Beta Participant Agreement

Effective Date: April 29, 2026

This agreement supplements the DutyRecoverAI Terms of Service and Privacy Policy, both of which apply to beta participants. This document governs the additional conditions specific to the private beta period.

You are using a beta version of DutyRecoverAI

The platform is under active development. Features may change, and some functionality may be incomplete or unstable. Your feedback is essential.

1. Beta Service Provided 'As-Is'

The DutyRecoverAI beta service is provided "as-is" and "as available" without any warranty, express or implied. During the beta period: • Features may be added, modified, or removed without notice. • The platform may experience downtime, data loss, or unexpected behavior. • There is no Service Level Agreement (SLA) — uptime, response time, and support response commitments in the standard Terms do not apply. • Beta pricing (including free access) may change when the platform transitions to general availability. DutyRecoverAI will make commercially reasonable efforts to notify beta participants of major changes and scheduled downtime.

2. No Reliance on Platform Output

Beta participants agree: • NOT to rely solely on DutyRecoverAI output as the basis for any customs filing, legal claim, or financial decision. • To have all recovery analysis reviewed by a licensed customs broker or qualified trade compliance professional before filing any claim with CBP. • That estimated recovery values are approximations generated by AI and should be treated as leads for professional review, not confirmed amounts. This restriction is in addition to (not instead of) the disclaimer in the Terms of Service.

3. Feedback

Beta participation is voluntary. We encourage (but do not require) you to: • Report bugs, unexpected behavior, and usability issues to beta@dutyrecover.ai. • Share suggestions for features or improvements. • Participate in a 30-minute user interview if invited. Any feedback you provide is non-confidential and DutyRecoverAI may use it to improve the platform without compensation or attribution to you. You retain no intellectual property rights in feedback you submit.

4. Data Handling During Beta

[PLACEHOLDER — Legal review required] During the beta period, your import entry data and account data are handled in accordance with the Privacy Policy. Additionally: • Beta data is hosted in the same production-grade infrastructure (Supabase, Vercel) as the general availability product. • We may review specific accounts' data (with prior notice where possible) to diagnose bugs or improve detection accuracy, subject to confidentiality obligations. • At the end of your beta participation, data retention follows the standard policy (90 days post-cancellation, 7-year packet retention). • If the beta program is discontinued, we will provide 30 days' notice and the opportunity to export your data.

5. No SLA During Beta

The following Service Level Agreement commitments do NOT apply during the beta period: • Uptime guarantees • Support response time commitments • Data backup frequency guarantees • Data recovery time objectives DutyRecoverAI's sole obligation during beta is to make commercially reasonable efforts to maintain service availability.

6. Right to Modify or Discontinue Beta

DutyRecoverAI reserves the right to: • Modify, suspend, or discontinue the beta program at any time, with or without notice. • Remove individual participants from the beta program at its sole discretion. • Transition the beta to a paid service at any time, with at least 14 days' notice to existing beta participants. Existing beta participants will be offered a path to a paid subscription before beta access is removed.

7. Confidentiality

Beta participants agree not to publicly disclose, benchmark, or publish reviews of the beta product without DutyRecoverAI's prior written consent. This confidentiality obligation survives the end of your beta participation for a period of [PLACEHOLDER: 12 months / 24 months].

8. Governing Terms

This Beta Agreement is supplemental to and governed by the DutyRecoverAI Terms of Service and Privacy Policy. In the event of any conflict between this Beta Agreement and the Terms of Service, the Beta Agreement controls with respect to beta-specific matters. For questions: beta@dutyrecover.ai
